SHOPUBBI CONSIGNMENT TERMS

These Consignment Terms govern merchandise submitted to or accepted by SHOPUBBI for consignment, remote consignment, or other resale services.
By submitting merchandise to SHOPUBBI and proceeding with an approved consignment, you acknowledge that you have read and agree to these terms.
Submission of merchandise does not guarantee acceptance.
1. Merchandise Acceptance
SHOPUBBI is a curated marketplace and reserves the right to determine which merchandise it accepts for resale.
Items may be evaluated based on factors including brand, condition, style, age, original retail value, estimated resale value, seasonality, current trends, customer demand, existing SHOPUBBI inventory, and authenticity where applicable.
SHOPUBBI may decline merchandise based on its marketplace and inventory requirements.
An initial submission or preliminary approval based on photographs does not necessarily constitute final acceptance. Merchandise may be subject to additional evaluation once physically received or further information is provided.
2. Seller Ownership & Authorization
By submitting merchandise, you represent that:
- You own the merchandise or are legally authorized to sell it.
- The merchandise is not stolen or otherwise unlawfully obtained.
- There are no undisclosed liens, ownership claims, or other restrictions preventing its sale.
- The information you provide to SHOPUBBI is accurate to the best of your knowledge.
- You have disclosed known issues that could materially affect the item’s condition, value, or authenticity.
SHOPUBBI may refuse or discontinue a consignment when ownership or authorization cannot reasonably be established.
3. Condition
Sellers are expected to accurately represent the condition of submitted merchandise and disclose known flaws, damage, alterations, or significant wear.
SHOPUBBI may assign its own condition rating based on its evaluation of the merchandise.
Our Pre-Loved condition categories include:
NWT — New With Tags
NWOT — New Without Tags
Excellent — Barely Worn
Great — Lightly Worn
Good — Gently Worn
Fair — Visible Wear
SHOPUBBI’s assessment may differ from the condition originally selected by the seller.
4. Authenticity
SHOPUBBI does not knowingly accept or sell counterfeit merchandise.
Designer and luxury merchandise may be subject to additional authentication procedures.
Depending on the merchandise, SHOPUBBI may consider characteristics including materials, construction, stitching, hardware, brand markings, serial or identifying information, provenance, and supporting documentation.
Technology-assisted authentication services may also be used where appropriate.
Sellers must disclose any known concerns regarding authenticity.
If SHOPUBBI cannot confidently stand behind the authenticity of submitted merchandise, it may decline or remove the item from sale.
5. Pricing
SHOPUBBI determines the listing price of accepted consigned merchandise.
Pricing may consider original and current retail value, comparable resale activity, brand, condition, age, rarity, desirability, seasonality, current trends, customer demand, and inventory levels.
The initial listing price is not a guarantee of the item’s eventual selling price.
6. Price Adjustments & Promotions
Resale values and customer demand change over time.
By consigning merchandise with SHOPUBBI, you authorize SHOPUBBI to make reasonable pricing adjustments and include merchandise in applicable promotional or markdown activity in an effort to facilitate a sale.
The seller’s commission is calculated using the actual final selling price after applicable discounts or promotions.
This means an item’s applicable commission tier may change if its final selling price falls into a different payout tier.
7. Seller Commission
For standard consignment, SHOPUBBI’s current cash payout structure is:
Final Selling Price — Seller Receives
Under $250 — 50%
$250–$499 — 55%
$500–$999 — 60%
$1,000–$2,499 — 70%
$2,500+ — 75%
Commission is calculated using the item’s final selling price, excluding applicable sales taxes, shipping charges, and other amounts not attributable to the merchandise itself.
The commission structure applicable to a consignment is the structure agreed to when the merchandise is accepted, unless the seller agrees to different terms.
8. SHOPUBBI Credit
Where offered, sellers may elect to receive their proceeds as SHOPUBBI Credit instead of a cash payout.
The current SHOPUBBI Credit payout structure provides an additional five percentage points:
Final Selling Price — Seller Receives in SHOPUBBI Credit
Under $250 — 55%
$250–$499 — 60%
$500–$999 — 65%
$1,000–$2,499 — 75%
$2,500+ — 80%
SHOPUBBI Credit may be used toward eligible purchases through SHOPUBBI.
SHOPUBBI Credit has no cash redemption value and cannot be exchanged for a cash payout once issued, except where required by applicable law.
SHOPUBBI Credit may be subject to reasonable account, fraud-prevention, and purchasing restrictions.
Any expiration terms, if applicable, will be disclosed before the seller elects SHOPUBBI Credit.
9. Payouts
A sale does not necessarily become immediately payable when a customer places an order.
SHOPUBBI may wait until payment has successfully processed and any applicable customer return or dispute period has passed before releasing seller proceeds.
Eligible seller payouts may be issued through available payment methods based on the seller’s country and SHOPUBBI’s current payment options.
Sellers are responsible for providing accurate payout information.
SHOPUBBI is not responsible for delays caused by incorrect information supplied by the seller, financial institution processing times, or circumstances outside SHOPUBBI’s reasonable control.
10. Customer Returns
Certain SHOPUBBI purchases may qualify for return under the applicable Returns & Refunds Policy.
If a consigned item is returned by the customer in accordance with SHOPUBBI’s policy, the transaction will not be treated as a completed sale for seller-payout purposes.
The merchandise may be returned to active inventory and offered for sale again.
If seller proceeds have already been issued for a transaction that is subsequently reversed, refunded, charged back, or otherwise invalidated, SHOPUBBI may offset the applicable amount against future seller proceeds or pursue another reasonable method of correction where legally permitted.
11. Local Consignment
Approved sellers in eligible SHOPUBBI markets may be able to deliver merchandise through an arranged local consignment drop-off.
Merchandise should be submitted and approved before drop-off.
SHOPUBBI locations and fulfillment facilities are not necessarily public retail storefronts.
Do not leave or deliver merchandise without an approved arrangement.
12. Remote Consignment
Eligible sellers across Canada and the United States may participate in SHOPUBBI’s remote consignment program.
Depending on the arrangement, SHOPUBBI may either receive the merchandise before listing or allow the seller to retain possession of approved merchandise while it is listed for sale.
The applicable process will be communicated when the merchandise is accepted.
13. Seller-Held Remote Merchandise
If you retain possession of merchandise while SHOPUBBI lists it, you agree to:
- Keep the item available for sale.
- Maintain it in substantially the same condition represented in your submission.
- Store it appropriately.
- Not wear, use, alter, or damage the merchandise while actively listed.
- Notify SHOPUBBI immediately if its availability or condition changes.
- Follow shipping instructions promptly after receiving notice of a sale.
If the merchandise becomes unavailable, SHOPUBBI must be notified immediately.
Repeated failure to maintain availability may result in removal from the remote consignment program.
14. Shipping After a Remote Sale
When seller-held merchandise sells, SHOPUBBI will provide applicable shipping instructions.
The seller must package the merchandise securely and ship it within the timeframe provided.
The merchandise shipped must be the same item and in substantially the same condition represented in the approved listing.
SHOPUBBI may cancel a transaction or withhold payout if the merchandise received materially differs from its approved listing.
15. Materially Misrepresented Merchandise
If merchandise is found to be materially different from the information, condition, or photographs provided by the seller, SHOPUBBI may decline the merchandise, cancel or remove its listing, return the merchandise, cancel an associated transaction, or take other reasonable action necessary to address the discrepancy.
Where SHOPUBBI incurs reasonable costs because of material seller misrepresentation, including authentication, shipping, customer refunds, or other direct costs, SHOPUBBI may seek reimbursement or offset those costs against amounts otherwise payable to the seller where permitted by law.
16. Unsold Merchandise
Consignment does not guarantee that merchandise will sell.
SHOPUBBI may periodically adjust pricing, merchandising, or promotional strategy to improve the likelihood of sale.
If SHOPUBBI determines that an item is no longer suitable for its marketplace, the seller may be contacted regarding available next steps.
Applicable return shipping or collection arrangements may be the seller’s responsibility unless otherwise agreed.
17. Withdrawing Merchandise
Sellers should contact SHOPUBBI before attempting to withdraw actively consigned merchandise.
A withdrawal request is not complete until confirmed by SHOPUBBI.
Merchandise cannot be withdrawn after it has been purchased by a customer or while a transaction is actively being completed.
For physically held merchandise, the seller may be responsible for applicable return shipping or other direct costs associated with returning the item.
18. Consignment Period
Unless otherwise agreed for a particular item or program, merchandise may remain listed while SHOPUBBI reasonably believes there is an opportunity for it to sell.
SHOPUBBI may remove merchandise that is no longer appropriate for its marketplace because of demand, age, condition, inventory requirements, or other reasonable commercial considerations.
Any specific minimum consignment period agreed to for an individual consignment will form part of that seller’s arrangement.
19. Direct Buyout
Select merchandise may qualify for a direct purchase offer from SHOPUBBI.
Direct buyout is not consignment.
If a seller accepts a direct buyout offer and the transaction is completed, ownership of the merchandise transfers to SHOPUBBI according to the applicable offer terms.
The standard consignment commission percentages do not apply to direct buyout transactions.
SHOPUBBI is not obligated to make a direct buyout offer for submitted merchandise.
20. Loss or Damage
SHOPUBBI will exercise reasonable care when handling merchandise physically in its possession.
If merchandise is lost or materially damaged while under SHOPUBBI’s control, any applicable resolution will take into account the circumstances of the loss or damage, available insurance or carrier coverage, and the merchandise’s reasonable resale value.
SHOPUBBI is not responsible for ordinary deterioration, inherent material defects, or circumstances outside its reasonable control to the extent permitted by law.
For seller-held remote listings, responsibility for the merchandise remains with the seller until it has been transferred according to the applicable shipping instructions.
21. Taxes
Sellers are responsible for determining and satisfying their own tax-reporting obligations associated with income received through consignment or direct buyout transactions.
SHOPUBBI may collect, report, or provide information where required by applicable law.
22. Fraud & Abuse
SHOPUBBI may suspend or terminate selling privileges where it reasonably suspects fraud, counterfeit merchandise, intentional misrepresentation, abusive conduct, manipulation of transactions, or other activity that threatens SHOPUBBI, its customers, or other sellers.
23. Changes to These Terms
SHOPUBBI may update these Consignment Terms as its marketplace, services, or legal requirements evolve.
Changes will apply prospectively unless otherwise required by law or agreed with the seller.
Material changes affecting an already accepted consignment will not retroactively reduce an agreed seller commission without the seller’s agreement.

If specific written terms are agreed to for an individual consignment or direct buyout, those specific terms will govern that transaction to the extent they differ from these general Consignment Terms.
