Welcome to SHOPUBBI. These Terms of Service govern your access to and use of shopubbi.com and your purchase or use of products and services offered by SHOPUBBI.
By accessing our website, creating an account, placing an order, submitting merchandise, or otherwise using our services, you agree to these Terms of Service and any additional policies applicable to the service you use.
If you do not agree to these terms, please do not use our website or services.
1. About SHOPUBBI
SHOPUBBI is a retail and resale marketplace offering a combination of Pre-Loved merchandise, brand-new SHOPUBBI+ products, UBBIKINI swim and resortwear, and other merchandise offered through SHOPUBBI.
Because our marketplace includes both resale and brand-new merchandise, product availability, condition, fulfillment methods, processing times, and return eligibility may vary by product.
Customers are responsible for reviewing the applicable product information before completing a purchase.
2. Eligibility
By using SHOPUBBI, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or that you are using SHOPUBBI with the involvement and permission of a parent or legal guardian where required.
You agree to use SHOPUBBI only for lawful purposes.
3. Accounts
Certain SHOPUBBI features may allow or require you to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You agree to provide accurate and current information and to update your information when necessary.
If you believe your account has been accessed without authorization, please contact SHOPUBBI promptly.
4. Product Information
SHOPUBBI makes reasonable efforts to present merchandise accurately.
Product descriptions may include information regarding brand, size, materials, condition, measurements, color, features, and other relevant characteristics.
Colors and appearance may vary slightly depending on photography, lighting, device displays, manufacturing variations, and other factors.
Measurements are approximate unless otherwise stated.
For Pre-Loved merchandise, reasonable signs of previous ownership may exist. Known material wear or flaws will be disclosed where reasonably identifiable.
Customers should review product descriptions, photographs, condition information, sizing information, and applicable policies before purchasing.
5. Pre-Loved Merchandise
Products identified as Pre-Loved are part of SHOPUBBI’s resale marketplace.
Pre-Loved refers to the item’s ownership or sourcing channel and does not necessarily mean that the merchandise has been worn.
Pre-Loved inventory may include:
NWT — New With Tags
NWOT — New Without Tags
Excellent — Barely Worn
Great — Lightly Worn
Good — Gently Worn
Fair — Visible Wear
Many Pre-Loved items are one-of-one and cannot be replaced with an identical item once sold.

6. SHOPUBBI+
Products identified as SHOPUBBI+ are offered as brand-new merchandise and are separate from SHOPUBBI’s Pre-Loved inventory.
SHOPUBBI+ merchandise may be sourced through brands, manufacturers, suppliers, distributors, wholesale partners, independent designers, and other commercial sources.
Different processing, fulfillment, or return requirements may apply to SHOPUBBI+ merchandise.

7. UBBIKINI
UBBIKINI is SHOPUBBI’s dedicated swim and resortwear brand.
UBBIKINI merchandise is offered as new merchandise unless explicitly stated otherwise.
Specific return restrictions may apply to swimwear and other hygiene-sensitive merchandise.
8. Pricing
Prices displayed on shopubbi.com are shown in the currency indicated on the website or during checkout.
Prices may change without notice.
SHOPUBBI reserves the right to correct pricing, product information, promotional, or typographical errors.
If a material pricing error is identified after an order has been submitted, SHOPUBBI may contact the customer regarding the error or cancel and refund the affected item where appropriate and legally permitted.
Applicable taxes, shipping charges, duties, or other charges may be added where required.
9. Orders
Submitting an order does not necessarily constitute final acceptance of that order.
SHOPUBBI may review orders before fulfillment.
An order may be declined or cancelled where reasonably necessary, including circumstances involving:
- Product unavailability
- Pricing or listing errors
- Payment authorization issues
- Suspected fraud
- Shipping restrictions
- Duplicate or unusual transactions
- Errors affecting the ability to fulfill the order
If SHOPUBBI cancels an order after payment has been collected, the applicable amount will be refunded.
10. Payment
Customers agree to provide current, complete, and accurate payment and billing information.
By submitting payment information, you represent that you are authorized to use the selected payment method.
Payment processing may be provided by third-party payment providers and may be subject to their applicable terms and privacy practices.
SHOPUBBI does not guarantee that every payment method will be available for every transaction or location.
11. Promotions & Discount Codes
SHOPUBBI may offer promotional codes, sales, discounts, credits, or other promotional incentives.
Unless otherwise stated, promotions:
- Cannot be combined with other offers.
- Cannot be applied retroactively.
- Have no cash value.
- May exclude certain products or categories.
- May be modified or discontinued where permitted by law.
Additional terms may apply to individual promotions.
12. Gift Cards & Store Credit
SHOPUBBI gift cards and store credits may be used toward eligible purchases according to the terms applicable when they are issued.
Gift cards and store credits are not redeemable for cash except where required by applicable law.
Promotional credits and seller SHOPUBBI Credit may be subject to different terms from purchased gift cards.
13. Shipping & Delivery
SHOPUBBI fulfills orders through a distributed network.
Products within the same order may be fulfilled from different locations and may arrive in separate packages.
Processing and delivery times vary depending on product type, inventory location, destination, carrier conditions, and other factors.
Delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

14. Returns & Refunds
Return eligibility depends on the merchandise purchased.
Pre-Loved merchandise, SHOPUBBI+ merchandise, UBBIKINI, furniture, oversized products, Final Sale merchandise, and hygiene-sensitive products may have different requirements.
Customers are responsible for reviewing applicable return information before purchasing.

Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection law.
15. Authenticity
SHOPUBBI does not knowingly offer counterfeit merchandise.
Applicable designer and luxury pieces may undergo SHOPUBBI’s authentication process, which may consider materials, construction, stitching, hardware, brand markings, identifying information, provenance, supporting documentation, and other relevant characteristics.
Technology-assisted authentication services may also be used for select merchandise where appropriate.

16. Resale & Consignment Services
SHOPUBBI allows eligible customers to submit merchandise for consideration through its resale services.
Submission does not guarantee acceptance.
Sellers whose merchandise is accepted for consignment are subject to the applicable Consignment Terms and commission structure.
Seller-specific matters including commission rates, SHOPUBBI Credit, pricing authority, payouts, remote consignment, item withdrawal, and seller responsibilities are governed by the Consignment Terms rather than these general Terms of Service.
17. Direct Buyout
SHOPUBBI may, at its discretion, offer to purchase select merchandise directly from a seller.
Direct buyout transactions are separate from consignment.
SHOPUBBI is not obligated to make a direct buyout offer for submitted merchandise.
Any specific terms provided with a direct buyout offer will govern that transaction.
18. Intellectual Property
Unless otherwise stated, content appearing on shopubbi.com, including SHOPUBBI branding, logos, graphics, website design, photographs created or owned by SHOPUBBI, text, product presentation, and other original content, is owned by or licensed to SHOPUBBI and is protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes.
You may not reproduce, distribute, modify, commercially exploit, scrape, republish, or otherwise use protected SHOPUBBI content without permission except where permitted by law.
Third-party trademarks, product names, and brand names remain the property of their respective owners.
The appearance of third-party brands on SHOPUBBI does not necessarily indicate sponsorship, partnership, authorization, or affiliation with SHOPUBBI.
19. User-Submitted Content
When you submit photographs, descriptions, reviews, feedback, or other content to SHOPUBBI, you represent that you have the right to provide that content.
Where content is submitted for the purpose of selling merchandise, you authorize SHOPUBBI to use, reproduce, edit, crop, format, and display that content as reasonably necessary to evaluate, market, list, and sell the applicable merchandise.
You remain responsible for ensuring that submitted content does not infringe another person’s rights or contain unlawful material.
20. Reviews & Feedback
If you submit a product review, testimonial, suggestion, or other feedback, you agree that SHOPUBBI may use that content for reasonable business, promotional, and customer-service purposes, subject to applicable law and our Privacy Policy.
Reviews must reflect genuine experiences and must not contain unlawful, fraudulent, abusive, defamatory, or infringing content.
SHOPUBBI may moderate or remove content where reasonably necessary.
21. Prohibited Uses
You may not use SHOPUBBI to:
- Engage in unlawful or fraudulent activity.
- Submit stolen or counterfeit merchandise.
- Misrepresent merchandise or transaction information.
- Attempt unauthorized access to accounts, systems, or data.
- Introduce malware, malicious code, or harmful technology.
- Interfere with the operation or security of the website.
- Scrape or harvest data in violation of applicable law or these Terms.

SHOPUBBI is not responsible for third-party websites or services that it does not control, except to the extent responsibility cannot legally be excluded.

SHOPUBBI works to maintain reliable access to shopubbi.com but does not guarantee uninterrupted or error-free operation.
The website or individual features may occasionally be unavailable because of maintenance, updates, technical problems, third-party service interruptions, or circumstances outside SHOPUBBI’s reasonable control.
24. Disclaimer
To the extent permitted by applicable law, SHOPUBBI’s website and services are provided on an “as available” basis.
SHOPUBBI does not make warranties beyond those expressly stated in its policies or those that cannot legally be excluded.

To the maximum extent permitted by applicable law, SHOPUBBI will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.
Where liability cannot legally be excluded, SHOPUBBI’s liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
26. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold SHOPUBBI harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of SHOPUBBI, your material violation of these Terms, your infringement of another person’s rights, or merchandise or information you knowingly misrepresent through SHOPUBBI.

Your use of SHOPUBBI is also subject to our Privacy Policy.
The Privacy Policy explains how personal information may be collected, used, disclosed, and otherwise handled in connection with SHOPUBBI’s services.
28. Changes to These Terms
SHOPUBBI may update these Terms of Service from time to time to reflect changes to its services, business operations, technology, or legal requirements.
The updated version will be published on shopubbi.com with an updated revision date.
Changes will apply prospectively except where otherwise required by law.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with the policies and any transaction-specific terms expressly incorporated into them, constitute the applicable agreement between you and SHOPUBBI regarding your use of the relevant services.
Seller transactions may additionally be governed by the Consignment Terms or specific direct buyout terms.
